The Excellent Expert Witness Deposition

How can lawyers and their expert witness achieve an excellent deposition? Trial attorney James Mizgala of Sidney Austin recommends the following:

• Tell the lawyer who retained you explicitly, the desired information, and get it
• Do not rely on counsel for your literature and background searches
• Be able to explain why you chose not to rely on arguably relevant information
• Anticipate potential challenges to your methodology and conclusions
• Adequately prepare for your deposition
• Know you expert report well
• Be able to explain your methodology clearly and in an articulate fashion
• Clearly and concisely articulate how you applied your methodology to the facts at hand
